Inspection, Quarantine and Hygiene Requirements for Wild Aquatic Products from Bulgaria to China

一、检验检疫依据

I. Legal Basis for Inspection and Quarantine

（一）《中华人民共和国食品安全法》及其实施条例、《中华人民共和国进出境动植物检疫法》及其实施条例、《中华人民共和国进出口商品检验法》及其实施条例。

1. Food Safety Law of the People’s Republic of China and its implementing regulations; Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine and its implementing regulations; Law of the People’s Republic of China on Import and Export Commodity Inspection and its implementing regulations.

（二）《中华人民共和国进出口食品安全管理办法》《中华人民共和国进口食品境外生产企业注册管理规定》。

2. Measures for the Administration of Import and Export Food Safety of the People’s Republic of China; Provisions on the Administration of Registration of Overseas Manufacturers of Imported Food of the People’s Republic of China.

（三）《中华人民共和国海关总署与保加利亚共和国农业和食品部关于保加利亚输华野生水产品的检验和卫生要求议定书》。

二、进口产品范围

II. Scope of Imported Products

野生水产品，是指野生的、供人类食用的水生动物产品及其制品、藻类等海洋植物产品及其制品，不包括活水生动物及水生动植物繁殖材料。

Wild aquatic products refer to wild aquatic animal products and their products, marine plant products such as algae and their products for human consumption, excluding live aquatic animals and aquatic animal and plant breeding materials.

三、生产企业要求

III. Requirements for Production Enterprises

1. 向中国出口野生水产品的生产企业（生产、加工、贮存企业）须经保加利亚官方批准并接受有效监管。
2. Production enterprises (production, processing and storage enterprises) exporting wild aquatic products to China must be approved and effectively supervised by the Bulgarian competent authority.
3. 企业食品安全卫生管理体系须符合中国相关法律法规要求。
4. The food safety and hygiene management system of the enterprises must comply with the relevant laws and regulations of China.
5. 生产企业须由保方向中方推荐注册，未经注册不得对华出口。
6. Production enterprises must be recommended and registered by the Bulgarian side with the Chinese side. Unregistered enterprises are not allowed to export to China.

四、进口产品要求

IV. Requirements for Imported Products

保方应确保输华野生水产品符合以下条件：

The Bulgarian side shall ensure that wild aquatic products exported to China meet the following conditions:

（一）在本国或国际水域合法捕捞。

1. Legally caught in national or international waters.

（二）原料及产品不存在严重影响安全的情形，包括重大疫病、重大食品安全事件、水域污染等。

2. Raw materials and products are free from circumstances that seriously affect safety, including serious aquatic animal epidemics, major food safety incidents, water pollution, etc.

（三）未使用中国禁用药物和添加剂，限用及允许使用物质符合中方规定。

3. No prohibited drugs or additives are used; restricted and permitted substances comply with Chinese regulations.

（四）经检验检疫，未发现中方关注的致病微生物、有毒有害物质、疫病、寄生虫等。

4. No pathogenic microorganisms, toxic and hazardous substances, infectious diseases or parasites of concern to China are found through inspection and quarantine.

（五）捕捞、加工、包装、贮存、运输、中转、出口全过程符合中国安全卫生及追溯要求。

5. The whole process of fishing, processing, packaging, storage, transportation, transit and export complies with China’s safety, hygiene and traceability requirements.

（六）包装和标签符合中国食品安全国家标准及进口食品管理规定。

6. Packaging and labeling comply with Chinese national food safety standards and regulations on imported food.

五、证书要求

V. Certificate Requirements

1. 保方对每批输华野生水产品出具官方卫生证书，证明产品符合中国规定。
2. The Bulgarian side shall issue an official hygiene certificate for each consignment of wild aquatic products exported to China, certifying that the products comply with Chinese regulations.
3. 证书须至少使用中文、英文，英文为必填语言。
4. The certificate must be printed in at least Chinese and English (English is mandatory).
5. 证书须完整填写生产企业信息，证书样本及印章须向中方备案，变更需提前 1 个月备案。
6. The certificate must fully include the production enterprise information. The certificate sample and official seal must be filed with the Chinese side; any change shall be filed one month in advance.

六、其他要求

VI. Other Requirements

1. 中国海关依法对进口保加利亚野生水产品实施检验检疫。
2. China Customs shall conduct inspection and quarantine on imported wild aquatic products from Bulgaria in accordance with laws and regulations.
3. 不合格产品作销毁、退运等处理。
4. Non-compliant products shall be destroyed, returned or disposed of otherwise.
5. 问题严重或多次不合格的生产企业，中方可加强查验或暂停进口。
6. For enterprises with serious or repeated non-compliance problems, China may strengthen inspection or suspend import.
